REGARDING THE NEW YORK TIMES VANDALISM INVESTIGATION

Last week, NYPD raided the homes of three people in connection with a July vandalism action on the New York Times offices. Three people were arrested and had many of their possessions confiscated, after which they were arraigned on felony charges. The following is an excerpt — with sensitive details redacted — from the police report on one of the accused persons. It reveals some concrete details about how NYPD investigates actions of this nature, including the extensive capacity of security cameras as well as the use of the MTA OMNY and Metrocard systems as a mass surveillance tool. This may not be the full extent of the techniques used — just what was necessary to include in the report.

I reviewed surveillance footage from July 30, 2025, at approximately 4:00 AM, depicting a group of individuals using various containers of red paint to spray and pour red paint on the New York Times building in midtown, Manhattan. This surveillance footage further depicted the following message left in white, capital letters on one of the glass windows of the New York Times building: “NYT LIES; GAZA DIES.” I observed leaflets left behind outside the New York Times building, which were titled, “THE NEW YORK TIMES IS STARVING GAZA.” The leaflets included a cartoon of two pigs painting pieces of paper in red lettering. The leaflets also read, in part, “THE NYT IS AN ACTIVE ACCOMPLICE IN THE ONGOING GENOCIDE.”
As part of my review of the above-described surveillance footage, I observed an individual spraying or pouring cans of paint on the sidewalk directly outside the New York Times building. The individual was dressed in all black clothing, wearing a face mask.
I additionally reviewed surveillance footage depicting 8th Avenue and 38th Street on July 30, 2025 at approximately 3:59 AM, two minutes after the above-mentioned individual poured or sprayed the paint. This footage portrayed said individual heading southbound on 8th Avenue. This footage additionally depicted said individual removing [a] black outer layer, thus leaving only a white tank top. I additionally reviewed video surveillance footage depicting 8th Avenue and 36th Street on July 30, 2025 at approximately 4:01 AM. This footage portrayed the above-mentioned individual wearing the above-mentioned white tank top, still walking southbound on 8th Avenue. In this video, said individual appeared to walk next to another…individual who was wearing black…I additionally reviewed video surveillance footage depicting the 34th Street Penn Station subway stop at the A-C-E train entrance on July 30, 2025 at approximately 4:03 AM. This footage portrayed the two above-mentioned individuals entering the subway platform at the turnstiles.
I reviewed subway fare information for the above date, time, and location to identify the OMNY cards that swiped into the station. Via the above-described review, I identified the OMNY card with serial number ——-
I proceeded to review OMNY card transaction history for the card with the above-mentioned serial number, and the card was purchased on July 29, 2025 at approximately 11:25 PM at the ——- subway station in ———, New York.
I reviewed video footage of the ——— subway station, depicting activities from July 29, 2025 at approximately 11:25 PM, and I observed an individual with the same build as the above-described individual appear to purchase an OMNY card at a machine. I followed that individual via video, and observed that same individual inside of [a retail business], located at ——— on July 29, 2025, at approximately 11:27 PM, purchasing an item without wearing a mask, and wearing a graphic t-shirt bearing a logo that read, ———. Said t-shirt was recovered from the defendant’s residence, pursuant to a search warrant. I followed this individual via video, and observed —- enter and exit a residential building in ———, both before and after 11:27 PM.
I am informed by State Trooper —— ———- , Shield No. ——, that after he conducted an investigation, he believed that the above-described individual is the defendant. I am further informed by Informant 1, a company representative known to the District Attorney’s Office, that an individual by the name of the defendant lives at the address at which the above-described individual was depicted on surveillance footage entering and exiting.
I am informed by a representative of the New York Times that he is a custodian of the above-described property, and that the defendant did not have permission or authority to damage said property.
Representatives of the New York Times shared invoices with me reflecting the costs incurred to fix the damage. I am informed by the above-mentioned invoices that the total cost required to fix the damage amounted to $107,599.54, consisting of $28,587.40 in cleanup costs, $7,154.64 in mag lock repair costs, and $71, 857.50 in façade repairs.


We hope that folks will develop their own takeaways, cross-referenced with other revelations about NYPD investigative practices, to develop more thorough understandings of tactical weak points of actions within NYC. We want to note that while police saw some success here, there have been countless actions of this kind in recent memory where nobody was identified. Most techniques of the state can be creatively juked. We have to believe that it is always possible to slip under the wire.

FREE FARE: Bedford L train station smashed

Monday night at the Bedford Ave L train station in Brooklyn, we smashed 8 OMNY readers, 1 OMNY machine, and 2 MTA machines. We made the fare FREE because they had to open the emergency door to let people in. This is in direct response to the L train mass shooting committed by NYPD, when they shot Derrel Mickells and two bystanders over $2.90, in a Black neighborhood under militarized police occupation. New Yorkers say enough is enough and fuck your fare.

We live in a world in which the pig enforcers of racial capitalism can casually shoot us over a few dollars. All our lives especially Black lives are worth less than $2.90 to them. Whether it’s paying the pigs to menace Black and Brown communities and restrict movement, for funding genocide near and far, or creating technology to convenience the rich and confine the poor, capitalism is designed to kill.

This is a call to action. Anyone can do this. Gather info, plan well, be covered, be their nightmare. Let’s all smash! Puncture the walls of the techno-prison and see real light, breathe real air, and destory the fare!

Hopping the turnstile isn’t enough. Likely you’ve already been hopping the turnstile for years and a call for a boycott is no change in your daily routine. But what if we cut off revenue for the most of the line? MTA and NYPD need to feel the heat.

Let’s redecorate all the L train stations. Make them free for everyone, and maybe leave some nice art on those annoying ads while we’re at it.

All you need is some superglue and giftcards to sabotage the card swipe. For OMNY I suggest something pointed like a pick, but I’m sure a hammer will do. Use your wrist. Bike locks for the emergency exits. I’m sure you know the drill. But in case anyone is unfamiliar or wants to jump in some newly radicalized comrades, here’s an old zine you can share around.

Ten OMNY Machines Smashed by the Transit Liberation Front

Recently, Black Revolutionaries in Atlanta sent out a call for a Summer of Resistance, a sustained, militant, and decentralized campaign targeting the multitude of appendages of the settler-colonial so-called United States, its Zionist client government, and their many accomplices in promoting a genocidal agenda in Palestine that is killing tens of thousands. In response, we turned our attention to the MTA and the touchless payment system, OMNY, that it is trying to shove down New Yorkers’ collective throat. These machines represent a world in which we must trade away our privacy for the right to move about our own city. The existence of OMNY and the city’s desire to phase out all other methods of payment is an obvious ploy to increase surveillance and further violate our communities by policing the main arteries of transit for everyday New Yorkers—as if the subways weren’t fucking crawling with police already.

We smashed ten of these machines in multiple subway stations across the city. We estimate that this is equivalent to about $40,000 in damage.

OMNY is in part result of a contract between the MTA and Cubic Corporation, a sprawling multinational entity owned by the private equity firm Veritas Capital [9 W. 57th St.]. Veritas’s portfolio also includes Peraton, which is working with the Department of Homeland Security to build HART. This advanced surveillance system will compile and centralize biometric and other data on nearly 300 million individuals, further facilitating DHS’s campaign of terror against immigrants and communities of color. This database, of course, will soon be open to Zionist security forces through DHS’s Enhanced Border Security Partnership, which promises rapid mutual biometric intelligence sharing among the Zionist entity, US, UK, and EU.

Veritas is invested in the oppressive technologies shoring up the imposed colonial borders that have been constructed on Palestinian land and between the United States and Mexico, ripping apart traditionally Indigenous territories. Here, at the margins, we see the extremity of state violence enacted against those it has decided to keep out by any means necessary, through both active violence—when the Zionist military murders Palestinians in cold blood—and passive, when US agents allow families to drown in the Rio Grande before their very eyes. These horrors are manifold, and Veritas is profiting from them.

If your city has a public transportation system, it is likely to be linked to Cubic and Veritas. Chicago’s Ventra system, London’s Oyster, the Breeze card in Atlanta, and countless other systems inside and outside of the US are all Cubic endeavors. Your governments are selling you out to a private company that actively promotes the imperialist projects from Palestine to Mexico. Why? In our view, they are rolling out an ever-more militarized version of the already extant police state. Cops flooding the subway and National Guard bag-checks are only the beginning. They are relying on us growing accustomed to being controlled in every aspect of our lives, of us willingly giving up our privacy in exchange for their rotten idea of “safety.” There is no safety under occupation, and we are indeed living on occupied territory. We may not yet face the same violence in the metropole as we see at the margins, but, as the resistance grows and the intifada is globalized, they are certainly getting ready in case we get too rowdy, too ungovernable. We are the frogs in the slowly heating pot.

Disabling these machines is just one small act of resistance, one that requires no more than a good, heavy hammer (16 oz. or more, no wooden handles), some safety equipment (goggles and protective gloves), and a solid plan for concealing your identity. we celebrated tort’s birthday by smashing all the omny readers and metrocard machines at a subway station in brooklyn. it was a fun and simple way to make this city pay for upping its efforts to police homeless people, black people and palestine solidarity protestors. in addition to gathering data on subway riders, omny’s parent company cubic sells hundreds of millions of dollars in surveillance tech to the “us” military and other militaries around the world. from nyc to gaza our enemies are the same. we know tort would agree.

We struck at the heart of midtown Manhattan where the State tries so hard to maintain their illusion of fascist control. We broke your pitiful OMNY machines, disabled your cameras, and glued your card readers right under Eric Adams and Kathy Hochul’s noses. We did our own subway maintenance with hammers, a little spray paint, and some super glue. Evade! Beat the fare! Fuck your $2.90! We reject the National Guard deployed in our city and subways. We reject the surge of NYPD in our subways and anywhere. We reject the State’s tax on free movement and fare enforcement that disproportionately targets Black and Brown communities. We reject the State’s fascist surveillance through OMNY and any new technology used to control the People.Fuck the Empire, Free Palestine! The same military, police, and surveillance tech they test out through genocide in Palestine they will also bring here to track, oppress, and lock us up. Borders are fake, and so are turnstiles.
